A man murdered the mother of his children by strangling her, wrapping her naked body in plastic and dumping it in a trailer before pretending to help ‘search’ for her.

Defendant Anthony James Bird, 48, of Kinmel Bay, North Wales, became enraged after finding out his partner of seven years, Tracy Kearns, was having an affair with another man.

Prosecuting barrister Ian Unsworth QC at Mold Crown Court he misled the police, her family and friends and even pretended to assist in the search for the mother of his two children – but all the time he knew that she was lying hidden in the trailer.

Prosecuting barrister Ian Unsworth QC at Mold Crown Court he misled the police, her family and friends while knowing that she was lying hidden in a trailer

Mr Unsworth said that the defendant denied the murder of Ms Kearns, 43, at the home they shared in Kinmel Bay between May 7 and May 11, but accepted that he was responsible for her death.

Opening the case to the jury, Mr Unsworth said that it was the prosecution case that the defendant attacked and strangled her to death.

‘That attacker was her partner, the defendant wrapped her body in plastic, and later removed her body from the house,’ he said. ‘Her naked body was left concealed under debris in a trailer.

 

Mr Unsworth said: ‘It was a cold and undignified end to a life cut short. It was a killing that was as contemptuous for her body as it was as ruthless in its execution.

Her family, friends and the police searched for her and the defendant played along with them.

 Mr Unsworth said he told ‘lie after lie’ and even sent a message to her phone.  

The couple both worked at the Sandy Cove Club in Kinmel Bay but the relationship had deteriorated and she started a relationship with another man, Andrew Jones.

The court heard the defendant discovered the relationship, the couple discussed it, and he appeared to accept that it was over and on the face of it he maintained that he did not want any arguments.

But on May 7 it was alleged that he had been waiting near her mother‘s home in Llandudno when she and Mr Jones returned home from a weekend together in Blackpool.

He spoke to Mr Jones and appeared to take it well, but asked them not to ‘rub his nose in it’.

He said he did not want her to move out or matters to be disrupted for their children

That night she met with Mr Jones at the club where she worked.

CCTV footage of her leaving was played to the court,

Mr Unsworth said that they were the last images of her seen alive and the court heard it appeared she travelled to the Rhyl area and met with Mr Jones before returning home.

Messages sent to her phone the following day by Mr Jones went unread, the court heard, and Miss Kearns’ body was found in the trailer at the Sandy Cove Club, owned by Bird’s brother Philip, on May 11.

The barrister said: ‘They discovered the body of Tracy Kearns. Her naked body was wrapped in black plastic sheets similar to pond lining tied and wrapped up using blue nylon rope and red tent like material.

‘The trailer also contained polystyrene blocks, two sandbags and blue piping,’ said Mr Unsworth.

Bird initially told police she had left him and came up with what the prosecutor described as ‘a clever and manipulative account’ by someone who knew that it was all a lie.

The court heard the defendant discovered the relationship, the couple discussed it, and he appeared to accept that it was over and on the face of it he maintained that he did not want any arguments

But following the discovery of her body, Mr Unsworth said, Bird ‘changed his account’, claiming his partner had charged at him with a pair of scissors and he held her right wrist with his left hand and squeezed her throat with his right hand ‘until she stopped moving’.

Bird said he removed her body from the house as their children slept.

‘On a wider view the overall picture here, you may think, is of a cold and calculating killing carried out in a ruthless manner by a man who was from start to last, in control,’ Mr Unsworth told the jury. 

Home Office pathologist Dr Jonathan Medcalf carried out a post mortem examination and Mr Unsworth said his findings that were ‘entirely consistent with a significant period of forceful neck compression.

There were fractures of the larynx and hyoid bone, a horseshoe shaped structure above the larynx within the neck. Microscopic examination revealed additional fracturing of the cricoid cartilage.

There was severe bruising of the upper chest, indicating either a heavy blow to this area or severe pressure, such as from kneeling on the upper chest.

In the opinion of Dr Medcalf, Tracy Kearns’s death was caused by a fatal assault involving manual strangulation.

Given the extent of the trauma to the neck, the degree of force involved was severe.   

Mr Unsworth said: ‘ We suggest that the numerous bruises to the body are certainly not explained by the defendant‘s account of him simply holding the victim’s right wrist while he strangled her.

‘The overall injury pattern provides clear evidence of a more sustained struggle and assault.

‘The overall picture here you may think is of a cold and calculating killing carried out in a ruthless manner by a man who was from start to last, in control,’ said Mr Unsworth.

The trial, before Mr Justice Clive Lewis, continues.
